Terms of Use

These terms of use (“Terms”) agreement between you (“You” or “Your Customer”) and Atashouse Pte Ltd (“We” or “Us” or “Our”), the owner and operator of the website www.cashbackland.com (The “Site”). This agreement states the Terms and Conditions that govern your use of the Site and the services and/or products sold on the Site. By accessing and using the Site, you accept and agree to comply with all of the terms and conditions of these Terms. If you do not accept these Terms, please do not access or use the Site or its services and/or products or register an account. AtasHouse Pte Ltd, Registration number 201540268G, is a registered company in Singapore.

Definitions

Merchant: Any provider of goods or services for legitimate sales, leads, clicks, etc on this ecommerce website. Member: Any person who has fully agreed to our terms & conditions and signed up with us as our member. Members are also our customers. Your Account: A specific account where cashback is credited and tracking records in place. AtasHouse: Means AtasHouse Pte Ltd and being referred to as “we”, “us” or “our” in this agreement. Commissions/cashback: AtasHouse acts as advertising agent for the merchants by sending online customers and traffic to them. For any successful sales, we receive commission from the merchants. We will reward our members/customers in the form of cashback or benefits in kinds. You would know the cashback % prior to your purchase.

Changes to Terms

Atashouse may add to, change, modify or remove any part of the Site, including, without limitation, any content therein, at any time without prior notice to you. When we make changes to these Terms, we will revise the “Last updated” date at the top of these Terms and we will post a notice of such changes on the Site. We encourage you to review these Terms whenever you visit the Site. By continuing to access and use the Site after any such changes have been posted, you are indicating your acceptance of such changes, even if you have not reviewed the changes. Terms & conditions may also be revised at any time by our merchants or agents/networks. Customers agree to comply with all revised regulations.

Personal Information/Privacy

Customers agree to provide accurate, current and complete information. Customer acknowledges that Atashouse uses a third party payment processing service (example, PayPal) to make cashback to your account. Atashouse’s Privacy Policy explains about our collecting, use and disclosing personal information. You hereby agree that we may use your personal information in accordance with the terms of the Privacy Policy.

Member Registration

Any person who has agreed to the terms & conditions and any agreements with AtasHouse will be granted membership. Multiple registrations by the same person is not allowed. Atashouse reserves the right to refuse membership to those whose membership is deemed ineligible.

Account

You have to be the beneficial owner of the Account and conduct business only on behalf of yourself. To be eligible to use AtasHouse services, you must be at least 18 years old or higher based on the age of majority in your jurisdiction. You represent, acknowledge and agree that (a) all account registration and bank details information that you submit is truthful, accurate, current and complete; (b) you will maintain the accuracy of such information and keep such information up-to-date; and (c) your use of the account, the Site, does not violate any applicable laws, rules or regulations. You should immediately notify Atashouse if you believe (a) there has been an unauthorised transaction or unauthorised access to your account; (b) there is an error in your Account statements; (c) you need more information about a transaction listed on the Account statement. You need not register with Atashouse to simply visit and view the Site. However, in order to access certain password-restricted areas of the Site, you need to register for an account. To register an account with us, you will need to create a password for your account on the Site (“Password”) during the account registration process. You are responsible for maintaining the confidentiality of your Password and you are responsible for all activities that occur using your Password. You agree to notify Atashouse if your Password is lost, stolen or disclosed to an unauthorised third party or if there is any unauthorised use of your Password or if you know of any other breach of security in relation to this Site. By using this Site, you may change, correct or remove any information from your account by either logging into your account directly and making the desired changes or contacting us. Atashouse reserves the right to suspend or terminate the services or accounts of members who breach or is reasonably suspected to be in breach of our prohibitions, rules, terms & regulations or for any detected or suspected frauds or mischiefs. You may close your Account at any time by following the instructions in your Account Profile. You must withdraw your balance prior to closing your Account. Upon Account closure, we will cancel any pending transactions and you will forfeit any balances therein. If your account is terminated or disabled for any other reason, then your cashback, cash bonus or other benefits will be forfeited. Any account that is inactive for six (6) months or more would be classified as dormant accounts. To help us reduce our admin workload and costs, we would require you to log in at least once every six (6) months, with or without purchases. We reserve the rights to terminate dormant accounts.

Transactions

Any transaction made by our customers with the merchants via our Site is a direct transaction between customers and merchants. Transactions are tracked by means of an identifying tag. For our cashback to take place, you need to log into our Site with the accompanying identifying tag at all times. Atashouse’s identifying tag and purchases must be completed and wholly online. If the merchant decides your online transaction was not genuine for any reason, or if goods are returned or amended or could not be identified been through AtasHouse, then your transaction will not be applicable resulting in no cashback or benefits in kind.

Cashback

Some merchants pay cashback on the purchase amount inclusive of tax and/or delivery charges and some exclude these in awarding cashback. Atashouse is not responsible for determining whether taxes apply to your transactions, or for collecting, reporting or remitting any taxes arising from any transaction. Merchants or their networks/agents may also vary their commission to us based on their terms & conditions. As such, the cashback that you would receive might be lower or higher then pre-determined. Not all items purchased are entitled to cashback, such as low value transactions or items determined by merchants or its networks/agents. Cashback received in your Account may be reversed, for example, if purchases made are reversed, invalidated or wrongly credited. We will do best to recover non-payouts from the mechants. The decision of ourselves, the merchants or its agent/s is final. We reserve the right not to chase missing cashback claims, particularly where no purchase has been made. If a merchant still has not paid a cashback claim after a period of six (6) months, then we reserve the right to close the enquiry claim. You agree that in all circumstances, payout of cashback is at our sole discretion and we may refuse to make payout of cashback or any benefits in kinds to you for any reason including but not limited to non-payout or late payout by the Merchant. It is your own due diligent to ensure that payout details are accurate. Payouts made to incorrect destinations may not be recoverable. There may be a recovery fee to trace the missing payout. We will not be held responsible or liable for any delays, loss or damages resulting from which. Any instructions given by you on your Account will be relied on by Atashouse and we will not be liable for any loss or damage to you or anyone else suffers, unless it was proven that Atashouse was negligent. We reserve the rights to reclaim or make balance adjustments for any cashback or benefits in kind that has been wrongly credited into your account.

Referrals

For referrals to be paid, the referred member must meet certain criteria such as minimum thresholds, US$15. Refer to FAQs “referral program”. Multiple accounts created by the same person or any fraudulent signups will result in no referral fees and/or termination of account.

Cookies

By using our Site, you have agreed to allow the cookies to be added to your system. Cookies are required to track your purchases and need to be enabled. Cookies are very common and harmless.

Compliance

In the use of Atashouse services, our website or in the course of your interactions with Atashouse, other users or third parties, you will not a) Act in any manner that is defamatory, threatening or harassing to our employees, agents or other users; b) Act in any manner that results or may result in complaints, disputes, claims, reversals, chargebacks, fees, fines, penalties and other liability to Atashouse or anyone; c) Breach the Terms & conditions or any agreement with Atashouse; d) Infringe Atashouse’s or any third party’s copyright, patent, trademark, trade secret or other intellectual property rights; e) Provide false, inaccurate or misleading information or engage in potentially fraudulent or suspicious activity and/or transactions; f) Use any viruses, Trojan horses or other computer programming routines that may damage, interfere with or expropriate any system ,data or information; g) Use of any robot, spider or other automatic device to monitor or copy our website without our prior written permission; h) Use of any electronic funds transfer methods which lead to or likely abuse of the card system or violation of payment network rules; i) Violate any law, statute, ordinance or regulation. This list of prohibitions provide examples and is not complete or exclusive. Atashouse reserves the right to restrict or terminate your access to your account, with or without notice, for any reason or for any action that AtasHouse determines its inappropriate or disruptive to this Site or to any other users of this Site and/or services on the Site. When legally required, Atashouse will cooperate with law enforcement agencies in any investigation of alleged illegal activity on this Site.

Reserve rights

We reserve the rights to enforce strict performance of any provisions provided herein and any failure of which do not constitute a waiver to subsequently enforce such provisions.

Disputes and Arbitration

This section facilitates the prompt and efficient resolution of any disputes that may arise between you and AtasHouse. Arbitration is a form of private dispute resolution in which persons with a dispute waive their rights to file a lawsuit, to proceed with court and to a jury trial, and instead submit their disputes to a neutral third party (or arbitrator) for a binding decision. For all Disputes, you must first give AtasHouse an opportunity to resolve the Dispute. You must commence this process by mailing registered written notification to 102 Henderson Crescent 08-24, S150102. That written notification must include (1) your name; (2) your address; (3) a written description of your Dispute; and (4) a description of the specific relief you seek. If AtasHouse does not resolve the Dispute within 60 days after it received your written notification, you may pursue your Dispute in arbitration. You may pursue your Dispute in a court only under the circumstances described below: (a) You OPT-OUT of this arbitration procedures within 30 days (the “Opt-Out Deadline”) from the date that you first consent to this Terms. You may opt out of this section by mailing registered written notification to 102 Henderson Crescent 08-24, S150102. Your written notification must include (1) your name; (2) your address; and (3) a clear statement that you do wish to resolve disputes with Atashouse through arbitration. Your decision to opt-out of this section will have no adverse effect on your relationship with Atashouse. Any opt-out request received after the Opt-Out Deadline will not be valid and you must pursue your Dispute in arbitration or small claims court.

Settlement of disputes

You agree that for any claims, Disputes or arbitration, it must be conducted and resolved in Singapore. All agreements shall be governed in all respects by the laws of Singapore as such laws are applied to agreements entered into and to be performed entirely within Singapore.

Disclaimer clauses

Atashouse will not be liable for any loss or damage caused by system glitch, breakdowns, transmission errors, loss of data, termination of account, viruses and/or other sufferings by members/customers in connection with the use of our Site and services or our merchants’. We do not guarantee that all information is clear, accurate, complete, correct or any suggestions on this Site or any part of which (directly or indirectly linked) and we do not accept liability or responsibility for any errors or omissions for any resulting loss or damage. We do not guarantee continuous, uninterrupted or secure access to any part of Atashouse services or Site which may be temporarily suspended for maintenance or upgrade or interfered with by factors beyond our control. We cannot be held responsible or liable if the merchant fails to report your sale to us. Merchants have their own rules upon which they determine transactions to be genuine. We cannot be held responsible or liable for any loss of cashback or loss of any other benefit which might otherwise have been gained. Any instructions given by you on your Account (through our Site, written or verbal) once you have been authenticated will be relied on by Atashouse. Atashouse will not be liable for any loss or damage you or anyone else suffers where Atashouse acts on those instructions in good faith. You are solely responsible for understanding and complying with all laws, rules and regulations of your respective jurisdiction that may be applicable to you in connection with your use of Atashouse’s Site and Services. We make no representations or warranties and do not have any control over, and are not responsible or liable for the products or services that you have purchased. Any of our terms and conditions or regulations that might contradicts to your country’s jurisdiction, the particular contradictory note would be an independent case. It does not make the whole terms and conditions or regulations void. In the use of our Site, www.cashbackland.com, and our services, with signing up as our member/customer, you have read, understood and accepted all the aforesaid Terms & Conditions and further agree not to hold Atashouse Pte Ltd, our officers, directors, associates liable or responsible for any loss, damage or sufferings incurred and to further indemnify us in any related 3rd party claims for all services provided by us or our networks/agents and our merchants’.
